Making a Claim - How Much Compensation Will I Receive? PDF Print E-mail

The level of compensation you are entitled to can depend upon many factors.

In order for us to give you an informed opinion of how much your compensation claim is worth, we will need to learn a little more about your injuries and your circumstances. Once we are in a position to tell your story, and have arranged a medical report that satisfies any doubts about the future, then we will guide you about the levels of compensation a court might award for pain, suffering and loss of amenity.

This type of compensation, which has to be assessed, is known as "General Damages".

To this we add past and future expenses, together with the value of any help you have received whilst recovering. These are known as "Special Damages".

Our team member are trained to ensure that no reasonable financial consequence is overlooked but we will ask that you keep full records.

  • General damages - No two injuries are the same so it is difficult to say what the courts will award. For example: A barman's broken finger would probably be worth less than if he were a concert pianist! Luckily there are guidelines published to help us categorise injuries and the sort of figures we may expect. Have a look at our own "Money-Man" for guidance....
  • Special damages - All past and future expenses, reasonably incurred as a result of the accident (provided you have tried to keep them to a reasonable level).

Different rules can apply if you are self employed and anticipate business losses. In this event you should speak to us as soon as possible in order to avoid losing out.

Otherwise the possible list is almost endless, but might include:
    • the cost of care bought in, or the value of help you have needed from friends and family.
    • Aids and Appliances purchased to help you get over your injuries.
    • Treatment costs if reasonable, even though it could have been provided free under the NHS. We cannot suggest the treatment you need but we can often make the arrangements for you.
    • The cost of alternative transport.
    • Loss of past and future earnings
    • Other out of pocket expenses such as prescriptions, travel to treatment, car parking etc.

Severe injury cases:

The cost of adapting or even changing accommodation to suit disabilities, coupled with the cost of an appropriate care regime can result in very high claims. We work with a range of experts to ensure your needs are reflected in any award.

Fatal Accidents:

These are a particularly specialist type of claim.

At a time when your world has been turned upside down you can be assured of a professional but sympathetic approach by very experienced lawyers. We will aim to provide a complete service, guiding you through Inquests and police cases as well as protecting your right to compensation

In addition to the general and special damages mentioned above further types of claim may arise:

  • A set award (£10,000 as at October 2006) for bereavement damages for the loss of a spouse, child under 18, or partner with whom you have lived for two years or more.
  • Financial compensation for loss of dependency (claimed by the Estate on behalf of all dependents)
