Uninsured Driver? PDF Print E-mail
If the person who caused your road traffic injury turns out not to have been insured then the Motor Insurers' Bureau (MIB) can be made to pay your compensation instead, under their Uninsured Drivers Scheme. It's a complex system but we'll guide you through the maze.

If you have been the victim of an uninsured motorist – all may not be lost.

The Motor Insurers Bureau (“MIB”) was created to compensate victims who have suffered injuries as a result of a negligent uninsured motorist under their Uninsured Driver’s Scheme.

What do I do?

If you believe that the responsible driver is uninsured, you should obtain all information you can about the driver, the vehicle and any potential insurance company.  The accident should be reported to the Police and it is advisable to do so within 14 days of the accident if injuries have been sustained and within 5 days if your claim is purely for damage to personal property.

We will then help you through the procedure in registering your claim with the MIB.

What happens next?

The MIB on received details of your claim will carry out investigations regarding any possible insurance cover – should any be found then that insurers may be asked to deal with your claim.  Alternatively if the MIB are satisfied that the other driver was uninsured and negligent for the accident, they will face your claim.

Are there any deductions?

The MIB, once satisfied the offending vehicle was fully negligent will pay your claim for personal injuries in full.  The downfall is that the MIB will not the first £300.00 of any property damage claim.  This is due to the fact that the scheme is primarily set up to compensate victims who have suffered the most rather than those who have suffered relatively minor damage to their property or vehicle.

How long have I got?

Any claim for personal injury or property damage must be registered within the MIB within 3 years of the accident date.

What if I knew the driver of the vehicle I was in was uninsured?

If you were a passenger in a vehicle and you were aware that the driver was uninsured compensation will not be payable through this scheme.
